PERM labor certification is a process you apply for through the U.S. Department of Labor (DOL). The employer files an I-140 Immigrant Petition and I-485 Application to Register Permanent Residence or Adjust Status with the U.S. Citizenship and Immigration Services (USCIS).
The DOL determines if there is a true lack of U.S. labor available for the job at hand. If there are not enough workers, an audit of the applicant’s qualifications determines if the application should progress to a work visa or not. It’s a long, complicated process. Plus, five employment-based immigration categories allow you to bypass a PERM labor certification application.
