EB-5 Investor Cases
The EB-5 Immigrant Investor Program is available to people who create at least 10 full-time jobs for:
U.S. citizens
Lawful permanent residents
Immigrants with legal authority to work in the U.S, excluding the investor’s immediate family
Those jobs must be created within two years. The investor doesn’t have to be part of the company’s day-to-day management, but they must maintain a policymaking role.
Also, the investor must make the minimum investment in the commercial business. Those investments must come from sources other than borrowed funds or bank loans. The minimum amounts (until the next adjustment in 2027) are:
$800,000 in an area with high unemployment rates
$1,050,000 in other areas
Suppose you own a popular beverage company in Asia, and you want to expand manufacturing to the U.S. You’re going to be hiring Americans and meeting the required capital investment. An EB-5 visa is the right choice.
Your spouse and unmarried children under the age of 21 also receive conditional permanent residency once you’ve made the required investment. After two years, you can apply for permanent residency with the USCIS using an I-829 petition.
Workers with extraordinary ability in the arts, athletics, business, education, or the sciences
Employment Second Preference (E2 Visa)
Persons with exceptional abilities in the arts, business, or the sciences
Professionals with advanced degrees and 5 years of progressive experience in the profession
Employment Third Preference (E3 Visa)
Professionals holding a four-year degree from a U.S. college or university, or the equivalent in the immigrant’s country
Skilled workers in jobs (not seasonal or temporary positions) requiring at least 2 years of training or work experience
Unskilled workers who can fill positions requiring less than 2 years of training or experience
Employment Fourth Preference (E4 Visa)
Afghan and Iraqi nationals or translators/interpreters who worked under the U.S. armed forces for at least 12 months
Certain foreign broadcasters
Certain foreign medical graduates
Certain former employees of the Panama Canal Company or government workers in the Canal Zone
Certain unmarried daughters/sons and surviving spouses of NATO-6 civilians or International Organization employees
Persons recruited outside of the U.S. who enlisted or served in the U.S. Armed Forces
Religious leaders and certain religious workers
Employment Fifth Preference (E5 Visa)
Immigrant Investors with the E-5 Visa program, as detailed earlier.
The PERM program allows U.S. companies to hire foreign workers for permanent positions in certain occupations, providing:
There are not enough U.S. workers available.
The employer has a valid Federal Employer Identification Number (FEIN).
The business is located within the U.S.
The wage meets the government’s prevailing wage requirement.

Non-Immigrant Visas
Short-term stays for any of the following require a non-immigrant visa. This is just a small list, as there are dozens of possibilities listed by the U.S. Department of State.
A: Diplomat or foreign government official
B-1: Business visitor
H-1B: Physician or field with highly focused knowledge
J: Au pair or exchange visitor
R: Religious worker
Citizenship and Naturalization
After an immigrant meets the requirements, they can acquire or naturalize to become U.S. citizens or lawful permanent residents.
Acquisition: Obtain citizenship at or after birth, but before you turn 18 if your parent is a U.S. citizen.
Naturalization: Become a lawful permanent resident after meeting the requirements of the Immigration and Nationality Act.
To become a U.S. citizen, you must have lived in the U.S. for at least 3 years (if married to a U.S. citizen) or 5 years (as a permanent resident). Paperwork precedes a formal interview with USCIS. After completing this interview, you must pass the Civics and English exams.
If you make it through those stages, you receive a notice to take the Oath of Allegiance and are sworn in as a U.S. citizen.
Family-Based Immigration
If a person comes to the U.S. for a job and gets a green card or is already a U.S. citizen or lawful permanent resident, family-based immigration allows relatives to join them over time.
F1: Unmarried children under the age of 21 of U.S. citizens
F2A: Spouses and unmarried children under the age of 21 of lawful permanent residents
F2B: Unmarried children 21 or older of lawful permanent residents
F3: Married children of U.S. citizens
F4: Siblings of U.S. citizens
K-1: Foreign fiancé/fiancée of a U.S. citizen
National Interest Waivers (NIW)
An NIW allows qualified foreign nationals to obtain an EB-2 employment-based green card based on an advanced degree or 5 or more years of experience of national importance. It’s much faster than the normal PERM process.
